On August 4th, CMS issued a Survey and Certification letter, Notification of Final Rule Published—Survey Team Composition and Investigation of Complaints. In the letter, CMS provides clarification regarding the regulatory requirements specified in a final rule published in the Federal Register on July 31, 2017 with respect to team composition for surveys conducted for investigating a complaint and to align regulatory provisions for investigations of complaints with the statutory requirements found in sections 1819 and 1919 of the Social Security Act (the “Act”).
